Access to and use of this site is subject to the following terms and
conditions, and the laws of England and Wales
This website is provided by Applestorm Limited of Harpenden, United Kingdom
('Applestorm').
The content (images and text) found on this site are copyrighted and the brand
names, trade marks, logos, labels and other designs that appear on this site
belong to Applestorm or have been licenced for use by Applestorm. By placing
these designs on this site, Applestorm is not granting a license to use or
reproduce them. You may however browse the site and download and print off
extracts from this site only for your personal, non-commercial use. The content
may not otherwise be copied, reproduced or distributed (unless permitted by
applicable laws) and may not be modified or incorporated into any other work,
publication or site, whether in hard copy or electronic form.
The information on this site has been included in good faith, but is for
general informational purposes only and should not be relied upon for any
specific purpose. Applestorm makes no warranties or representations as to its
accuracy or completeness and shall not (except where that liability cannot be

Applestorm collects information that can identify you only when it is
voluntarily offered. We only use this information in accordance with our
Privacy Policy, which is described
below.
Any non-personal information, communications or material you send to this site
or other sites provided by Applestorm, or which are sent by electronic mail,
are on a non-confidential basis. We are free to use and reproduce any such
information freely, and for any purpose whatsoever. Specifically, we will be
free to use any ideas, concepts, know-how or techniques contained in such
information for any purpose, including developing, manufacturing or marketing
products and services.
Any information you send to this site or other sites provided by Applestorm
must be truthful, and not infringe the rights of others and be legal.
Applestorm reserves the right to add to, change or withdraw products and
services referred to on this site and to change the contents of this site,
including this Legal Statement, at any time without notice.
Conditions of Sale
General
All orders for products or services are accepted by Applestorm Limited
('Applestorm') subject to our conditions of sale.
Customers should obtain confirmation in writing before relying on anything
published on this website. Applestorm cannot be held liable for any errors that
appear on this website and reserves the right to make any changes to this
website without notice.
Although this website is primarily aimed at business users, nothing written in
these conditions shall affect the statutory rights of a Customer who deals as a
consumer.
Prices
The prices of the products and services given on this website are current for
the time of dispatch or service activation. All prices exclude VAT unless
otherwise stated. Applestorm reserves the right to adjust its prices at any
time, although price changes will not apply to quotations already made to
customers who have placed orders for products not currently in stock or
services yet to be activated.
Acceptance of Orders
Applestorm reserves the right to accept or decline an order. Notice of declined
orders will be given to the Customer within a reasonable period by telephone or
fax.
In processing Customer orders Applestorm will not substitute one product or
service for another without the confirmation of the Customer. If a product is
out of stock or a service is temporarily or permanently unavailable we will ask
the Customer to confirm a suitable course of action.
The Customer may not cancel orders once accepted by Applestorm. Applestorm may,
at its discretion and in writing, allow an order to be cancelled subject to
Applestorm recovering any costs incurred from the Customer.
Delivery
Options and prices for delivery will be calculated and notified to the Customer
prior to an order being accepted. Applestorm will endeavour to deliver products
in accordance with the Customer's wishes although times and dates for delivery
must be considered approximate and Applestorm may not be held liable for the
consequences of any delay in delivery.
If a delivery is late, the Customer must notify Applestorm within a reasonable
period at which point Applestorm will confirm the status of the delivery with
the appropriate courier service and convey this to the Customer. Applestorm
will also, at its discretion, refund the total delivery charge to the Customer.
This is the Customer's sole remedy for late delivery.
The Customer must refuse to accept parcels or packages delivered to it in a
damaged condition.
The Customer must inspect the products as soon as is reasonably possible after
delivery and shall give notice of any defect or delivery error including
shortfalls and non-delivery, within 10 days of the date of delivery. Applestorm
will, at its discretion, either deliver the undelivered products, replace the
defective products or refund the price of the products in question.
If the Customer fails to give any such notice, the delivery shall be
conclusively presumed to be, in all respects, in accordance with the Customer's
order and free from apparent defects, and the Customer shall be deemed to have
accepted the products accordingly.
These shall be the Customer's sole remedies for non-delivery of products or for
apparent defects in the products. Applestorm may not be held liable for any
losses due to these circumstances
Payment
If Applestorm has not agreed a credit facility with the Customer, payment terms
are cash with order. Written details of credit terms are available upon
request.
If any amount is not paid by the due date, Applestorm may, without prejudice,
charge the Customer interest from the due date until payment is made in full on
the amount unpaid at a rate which is 8 per cent per annum above the Lloyds TSB
Bank base rate from time to time, compounded monthly.
Ownership
Ownership of products shall not pass to the Customer until all amounts due to
Applestorm from the Customer for those products have been received by
Applestorm in cleared funds, although risk of loss of or damage to the products
shall pass to the Customer upon delivery. If the Customer is late in paying any
amount to Applestorm, then Applestorm shall be entitled to the immediate return
of all products where the ownership has not yet passed to the Customer.
Warranty
For Products
Applestorm warrants that for a period of one year (or longer period for certain
products), any products supplied to the Customer will be free from defects and
will, at its option replace or repair the product or refund the purchase price.
Full details of Applestorm warranty are available upon request.
For Services
Applestorm warrants that any service it supplies will be as described and
otherwise free from defects for the period of supply as agreed with the
Customer at the time of order. Applestorm also warrants that services which
rely on the availability of Applestorm's network connectivity will be available
to Customers with an appropriate network connection at least 99 per-cent of the
time during normal working hours. Where Applestorm fails in either respect to
supply a service to the Customer, it will, at its option, either rectify the
service, supply to the Customer free of charge an equivalent or refund to the
Customer a proportion of the price paid on a pro-rata basis for any time that
the service was unavailable.
These warranties shall not apply to any defect which arises from improper use,
failure to follow the product instructions, or any repair or modification made
without Applestorm's consent.
Returns
The Customer may only return products to Applestorm with Applestorm's explicit
consent. Further information on Applestorm's policy on returns and details of
handling and other charges which may apply are available upon request.
Force Majeure
A force majeure event is any event beyond the reasonable control of Applestorm
(including strikes, traffic congestion, the downtime of any external line, or
Applestorm's inability to procure services, materials or articles required for
the performance of the contract except at enhanced prices). If Applestorm is
prevented or restricted from carrying out all or any of its obligations under
these conditions of sale by reason of any force majeure event, then Applestorm
shall be relieved of its obligations during the period that such event
continues, and shall not be liable for any delay and/or failure in the
performance of its obligations during such period. If the force majeure event
continues for a period longer than fourteen days, Applestorm may cancel the
affected order or cancel the whole or any part of these conditions of sale,
without any liability to the Customer.
Applicable Law
The contract between Applestorm and the Customer shall be governed in
accordance with English Law and the Customer submits to the jurisdiction of
courts in England, but Applestorm reserve the right to enforce the contract in
any court of competent jurisdiction.
Privacy Policy
Applestorm Limited promises to respect the privacy of its online visitors. This
privacy policy describes what personally identifiable information we collect
when you visit our website, how we use that information, and your choices with
respect to our use of any personal information about you. Personal Information
includes names, addresses, email addresses, payment information, and any other
personal information you voluntarily provide, for example by entering a
competition, completing an online questionnaire, or giving credit card details
when purchasing products or services from us. We collect personal information
only if it is offered voluntarily by you. We use the personal information
collected online to provide you with the product, service or information you
may have requested, reply to your comments or questions or to inform the
winners of any competitions.
Disclosure of Personal Information
We may provide your personal information to our sub-contractors or service
providers, such as companies who handle our order fulfilment. This will be done
only where totally necessary to provide a high quality service to you, and only
on terms which ensure that your personal information is safeguarded and held
securely. Where a sub-contractor or service provider or a relevant department
of a sub-contractor or service provider is not located within the UK, we may
also transfer your personal information to countries outside the European
Economic Area (EEA) to a country that may not have similar data protection laws
to those in the EEA. In any case, your personal information will be treated
with the same standards of protection and security as are described in this
Privacy Statement. Except as described in this Privacy Policy, or as required
by law, we will not share your personal information with any third parties
unless we have your consent or you were notified of this when we collected your
personal information.
Access to your Personal Information
Wherever practicable, we will offer you an opportunity to choose whether or not
to receive further information from Applestorm when we first collect your
personal information. You may also ask us at any time not to re-contact you or
send you any further information by sending an email to
support@applestorm.com. We will always respect your wishes on this
matter. If you wish to update or correct your personal information, or to
receive details of how to access your personal information, you may do so by
sending an email to

your personal information.
Use of Cookies and Related Technologies
As with most websites, our servers automatically collect certain technical
information such as your IP address, the date and time of your visit, and
information about the browser you use. We do not use this information to
identify you. This information helps us determine the total number of visitors
to the site on an ongoing basis and the types of Internet browsers (e.g.,
Internet Explorer or Netscape Navigator) and operating systems (e.g., Windows
or Mac) used by our visitors. Like many other companies, we also use 'cookie'
technology, where our servers deposit special codes on a visitor's computer.
This information is used only to provide you with an interactive website
experience. Under no circumstances do we use this information to identify
visitors or cross-reference this information with personal information you may
provide on the site. If you wish, you can set up your browser so that you do
not receive any 'cookies' while visiting the site, but if you do so you may not
be able to use all the on-line options otherwise available.
Web Hosting Acceptable Use Policy
Subscribers to Applestorm's Web Hosting service are granted limited permission
to make use of Applestorm's network for the purpose of hosting an Internet
website, which includes commercial use. Access is provided for the use of the
registered contact only. You must not divulge your password or other access
credentials to any other person and you should take reasonable precautions to
ensure that they are not discoverable by other people.
You must not host or allow to be hosted any illegal, offensive or otherwise
inappropriate material. The discovery of any such material in your allocated
Web Hosting space or elsewhere in any allocated file storage facility will
result in the immediate cancellation of the Web Hosting service, the suspension
of any other services provided by Applestorm and the deletion of all files,
whether of a prohibited nature or not. No refunds will be given for services
already paid for under such circumstances.
Prohibited materials includes, but is not limited to: adult content or images
depicting scenes of a sexual or otherwise graphic nature; Warez or any
unlicenced, pirated or otherwise unlawfull software including unauthorised
licences, licence codes or serial numbers; unauthorised multimedia including
MP3 files; any works subject to copyright or trademark laws without the written
consent of the owner.
Users of Web Hosting services must not participate in any form of un-solicited
bulk e-mailing or spam. Where personally identifiable information about
visitors to your website is collected, you must prominently post a Privacy
Policy on your site and provide a copy to Applestorm. Your service may be
suspended if you engage in un-solicited bulk e-mailing or you are otherwise in
breach of your own Privacy Policy.
If you choose to host materials of a defamatory, confidential or otherwise
proprietary nature, you will be held entirely responsible and accept
responsibility for this action. You will indemnify Applestorm against any loss
which occurs as a direct or indirect result of your actions in the above.
You may not run server processes or other executable files from within your Web
Hosting space, unless agreed by Applestorm in writing. You may not include third
party scripts (unless they are served
from your own site with the permission of the author) on any page in your Web
Hosting space. You may not link to any external site for the purposes of
tracking the activity of visitors to your site or otherwise do anything which
could infringe the privacy or reveal the identity of visitors to your site,
unless this is done within the bounds of a posted Privacy Policy which has been
approved by Applestorm.
Data stored on our systems is regularly backed up and we will endeavour to
restore any data which is lost for any reason, but this cannot be guaranteed.
Applestorm recommend that you keep an independent backup of all data stored in
your Web Hosting space and will not be held liable for any loss or damages
caused by the accidental deletion of your data.
Applestorm may cancel your Web Hosting account where, in the sole opinion of
Applestorm, a serious breach of this Acceptable Use Policy has occurred. Less
serious breaches may, at Applestorm's discretion, result in suspension of
service or removal/modification of files stored in your Web Hosting space.
Applestorm may make a charge of £5 per page for removal or modification of
pages following a breach of this Acceptable Use Policy.
When your Web Hosting account is closed, all files will be permanently deleted.
Subscribers to the 'Starter' Web Hosting package agree that Applestorm may attach
an invisible notice to the bottom of the home or primary static page in the
Web Hosting space stating that "This site is hosted by Applestorm Limited."
Applestorm reserves the right to update this Acceptable Use Policy at any time
without notice.
By logging into or accessing your personal account you are indicating your
acceptance of this policy.
